We offer this website, including all information, tools, and services (specifically the sale of digital products – eBooks) available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

SECTION 2 — PRODUCT DEFINITION AND ACCESS

1. The subject of sale is Digital Products (eBooks) in PDF format.

2. Upon successful payment, the product is delivered electronically to the email address provided by the Customer in the order form.

3. The Customer is responsible for providing a correct email address and ensuring they have software capable of opening PDF files.

SECTION 3 — RETURNS AND RIGHT OF WITHDRAWAL (FINAL SALE)

1. NO RIGHT OF RETURN: In accordance with Article 38, point 13 of the Polish Act on Consumer Rights (and the EU Consumer Rights Directive), the right to withdraw from a distance contract does not apply to digital content not supplied on a tangible medium if the performance has begun with the consumer's prior express consent.

2. INTERNATIONAL CUSTOMERS (USA, CANADA, AUSTRALIA, UK): By completing your purchase and accepting these terms, you expressly consent to the immediate delivery of digital content and acknowledge that all sales are final. You understand that you lose your right to a refund or withdrawal once the digital file has been sent or made available for download.

SECTION 4 — COMPLAINTS AND TECHNICAL DEFECTS

1. We strive for the highest quality. However, if a file is corrupted, does not open, or is incomplete, the Customer has the right to file a complaint.

2. Complaints must be sent to contact@zwierzswiat.com with the order number included.

3. We will review the complaint within 14 days. If approved, we will send a functional file or issue a refund via the original payment method.

SECTION 5 — INTELLECTUAL PROPERTY AND USAGE RIGHTS

1. All content in the Store and eBooks (texts, graphics, layout) is the property of EverSmile and is protected by international copyright laws.

2. Purchased eBooks are intended for the personal, non-commercial use of the buyer only.

3. You are strictly prohibited from copying, modifying, reselling, sharing on P2P networks, or publicly distributing this content without prior written consent. Violation of these terms may result in civil and criminal liability.

SECTION 6 — MEDICAL & VETERINARY DISCLAIMER

2. We reserve the right to change prices or introduce promotions without notice. The price at the time of order placement is binding.

You are prohibited from using the site or its content for any unlawful purpose, to solicit others to perform unlawful acts, to transmit viruses/malicious code, or to infringe upon the intellectual property rights of others.

1. LIMITATION OF LIABILITY: In no case shall EverSmile, our directors, or employees be liable for any injury, loss, claim, or any direct, indirect, or incidental damages of any kind arising from your use of any of our services or products.

2. GOVERNING LAW: These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Poland. Any disputes shall be resolved by the competent courts of Poland.
